1.10 - Remand Procedures

Remand refers to when a person is held in custody whilst awaiting trial or sentencing.

A remand application must be made in writing to a court as soon as possible. A court may approve a remand application if they have satisfied it meets one of the following circumstances exist:

  • Based on their history the defendant is likely to abscond if they are released on bail whilst awaiting trial.

  • The nature of the alleged offending was more serious than normal.

  • If the alleged offender has a history of committing violent offences.

  • If a court is unavailable an officer holding the rank of Inspector or above may approve a provisional remand for a maximum of 24 hours. If court approval cannot be gained within this 24-hour period, then the suspect must be released.

Failure to pay will result in the suspension or removal of the businesses' licence.
