9.3 - Powers Of Police

Officers of the Eclipse City Police Force, the Protective Services Officers and the Federal Police are tasked to uphold the law and may reasonably exercise the following powers:

  • Power to require identification

  • Power to detain an individual

  • Power to phone track

  • Powers to move along

  • Power to administer a Gunshot Residue Test (If the individual is seen entering, being present or leaving the immediate area of an active crime scene or if reasonable grounds have been satisfied)

  • Power to retrieve a DNA Sample (If the individual is seen entering, being present or leaving the immediate area of an active crime scene or if reasonable grounds have been satisfied)

  • Power to administer a Blood Alcohol Concentration (BAC) and Drug test (If the individual is seen operating a vehicle, or display signs of intoxication or impairment)

A police officer must also satisfy Reasonable Grounds when exercising the following powers:

  • Power to search without warrant

  • Power to confiscate evidence and illegal items

  • Power to pursue a suspect, and impose tactical contact

  • Power to enter a property without a warrant

Police officers must also satisfy the 10 Points for Prosecution to exercise the following powers:

  • Powers to arrest and convict a suspect unless the accused is being prosecuted through the Courts by the Office of the Director of Public Prosecutions.

  • Powers to tow and impound vehicles and aircraft in accordance and Aviation laws.

Officers of the Federal Police may investigate Emergency Services Officers for acts of misconduct
